Considerations for lesbian, gay, bisexual, and transgender relationships

The law across the country is in flux regarding civil unions, domestic partnerships, and same sex marriage and as to the recognition and dissolution of these relationships.

As of 2011, Colorado does not recognize same sex unions or common law marriages between same sex partners. As a result, gay and lesbian couples do not have the same legal protections and allowances as married couples, and creative solutions may be critical to solving problems and protecting rights of our lesbian, gay, bisexual, transgender clients.

Legal issues related to division of property, maintenance, inheritance rights, and a host of other matters can and should be addressed. The attorneys at Lapin | Lapin, P.C. are able to assist in the preparation of contracts, wills, powers of attorney, healthcare proxies, partnership agreements, co-habitation agreements, and a variety of other options to protect an individual’s rights and the rights of a couple.

The lawyers of Lapin | Lapin, P.C. have the knowledge and sensitivity to handle legal issues faced by LGBT individuals and couples, including the following:

  • Domestic partnership agreements
  • Pro-habitation agreements
  • Division of property upon separation
  • Custody and support of children whether adopted or not
  • Estate planning including wills, trust documents, and Powers of Attorney
  • Tenancy agreements
  • HIPPA regulations and healthcare directives
  • Transfer or real estate and other property
  • Contracts
  • Parenting agreements concerning children

Given the uncertainty of the law from a judicial as well as a legislative perspective, gay and lesbian couples should take extra care to address their legal relationships.

Whether it is a matter requiring urgent attention, such as a temporary restraining order or injunction, an upcoming hearing or negotiation in which you need representation, or a longer term process leading to the resolution of a contested matter by settlement conference or hearing, we explore all opportunities for alternative dispute resolution to encourage our client’s control over the outcome. Nevertheless, we are well prepared to take your case to trial and appeal if necessary. Providing prompt personal attention to your case is the hallmark of our practice.
